The UK Bird Nesting Season (March–August)
Contrary to popular belief, it IS NOT ILLEGAL to undertake tree work during the UK's bird nesting season. However, under the Wildlife and Countryside Act 1981, it IS ILLEGAL to damage or destroy an active nest intentionally. This applies to all birds, not just rare species. If a nest is found in a tree or hedge, work must be delayed until the birds have fledged.
However, bird nesting season isn’t the only time to be cautious. Many birds, such as pigeons and doves, nest outside of the typical season, and some species, like barn owls, use the same nest year after year.
This is why we always conduct detailed site assessments before starting any job - no matter what month it is.
Bats & Other Protected Wildlife
It’s not just birds you need to consider. Bats, which often roost in older trees, are protected under the Wildlife and Countryside Act 1981 and the Conservation of Habitats and Species Regulations 2017.
If bats are found in a tree, a licensed ecologist must assess the site before any work is carried out. Disturbing a bat roost without the proper permissions can result in severe fines or prosecution.
